Town of Samburg, Tennessee - Citizens, Residents and Property Owners - Need Your Help to Clean Up the Community to see the Town of Samburg Ordinances are enforced correctly.
The Town of Samburg has adopted several Town Ordinances pertaining to: “Littering” - Town Ordinance No. 10-226, Town Ordinance No. 10-207, “Junkyard Controls” Town Ordinance No. 10-244, “Sewage Disposal” Town Ordinance No.8-200, “Establish Property Maintenance Regulations” Town Ordinance No. 10-235, and the requirements of the Tennessee Slum Clearance and Redevelopment Act, Tenn. Code Ann. § 13-21-101 et seq.- they are not being enforced by the Current - Town of Samburg Elected Officials

Town of Samburg Community Volunteers Needed to clean up the "Junk" in residents & property owners yards.
"Junk" is defined in Ordinance Code No. 10-244 as:
"Junk" means old or scrap copper, brass, rope, rags, batteries, paper, trash, rubber, debris, waste or junked, dismantled or wrecked automobiles, or parts thereof, iron, steel, or other scrap ferrous or nonferrous material"
The Town of Samburg has started a major clean-up project within its Incorporated limits as required by the above Town Ordinances of the Town of Samburg and Tennessee laws.
(click) The Public Notice posted and issued on August 10th 2011 - was to advise all Property Owners of the Town of Samburg and all citizens that live inside the Incorporated limits of the Town of Samburg and/or own real property inside of the Town of Samburg Incorporated limits as defined in the 1947 Town’s Incorporation Charter, that under the requirements of the above Town of Samburg Ordinances and Tennessee law, the above Town of Samburg Ordinances has to be enforced as required by law, otherwise each elected official can be sued in a Tennessee Court of Law for not doing his/her duties as a elected official to protect the public health, safety, and welfare of the citizens of the Town of Samburg and the public at large.

Other Town of Samburg official's Alderman John VanCleave & Alderman Johnie Johnson was not informed prior to or even asked to attent. (Confirmed by Alderman Johnson & VanCleave)The health, welfare and safety of all the resident and property owners living in the Town of Samburg was affected by their decision to not enforce the above ordinances. (No Enforcement definitely at this time was what they decided due to a couple of the local polication in the Town of Samburg putting pressure on a couple of the Town's elected officials behind closed doors.)The secret meeting was designed to elude observation and/or detection by the residents of Samburg and to make a formal decision without public notice being given.Local- Townof Samburg Slum Lordswhich own property in violation of the above Health & Sanitation Ordinances forced this illegal meeting to happen by putting pressure on Alderman Fickle.(Notea Slum Lords defined: is a landlord who receives unusually large profits and rents them to poor people or use the substandard properties in violation of health and sanitation ordinances. Most of their properties are not fit for human use. Their properties allow accumulation or creation of unwholesome and offensive matter or the breeding of flies, rodents, or other vermin on the premises to menace of the public health or the annoyance of people residing within the vicinity and Town)The Sunshine Law establishes "... that the formation of public policy and decisions is public business and shall not be conducted in secret " (T.C.A. Sect: 8-44-101) furthermore TCA - Sect: 8-44-101 - states: The law applies to formal meetings that require a quorum and to informal meetings of two or more public body members if they have the authority to make decisions for or recommendations to a public body. If the participants in the meeting "deliberate toward a decision" then the meeting should be open to the public. Public-body members may not use telephones or other electronic communications to evade Sunshine Law Requirements (TCA - Sect: 8-44-102). At meetings, all votes must be public. Secret ballots are not allowed (T.C.A. Sect: 8-44-104. What are the penallties for violating the Tennessee Sunshine Law?Under T.C.A. Sect: 8-44-105, the sanctions are severe. Any action taken at the meeting in violation of the Act shall be void and of no effect... Official Misconduct charges can be filed against the elected official under the authority of Tennessee Code - Section 39-16-402 at sections: (a)(3) Refains from performing a duty that is imposed by law or that is clearly inherent in the nature of the publice servant's office or employment; or(a)(4) "Violates a law relating to the public servant's office or employment.Satutory remedies of nullification and injunctive relief and penalties, among other things, for a violation of Open Meetings Act (Sunshine Law) are not meant to be mutually exclusive. (T.C.A. Sect: 8-44-105. Zseltvay v. Metropolitan Govenment of Nashville and Davidson County, 986 S. W. 2d 581, appeal denied (Tenn. Ct. App. 1988). T.C.A. Sect: 8-44-106 gives the Court jursdiction over the parties and subject matter for a year, with powers of injunctive relief. and;Also the elected officials are subject to removal from the elected office under the authority of Tennessee Code section 8-47-101. -(Official Misconduct law) "who shall knowingly or willfully commit misconduct in office, or who shall knowingly or willfully neglect to perform any duty enjoined upon such officer by any of the laws of the state"....
